Regulatory Framework of Financial Markets

Introduction

The training Course “Institutional Framework of Financial Markets” is structured in three self-contained teaching/thematic units, lasting three, two and four months respectively. The Course aims to provide in-depth information on new pre-insolvency restructuring procedures, such as the out-of-court mechanism for the settlement of business debts as it is to be reshaped under the New Bankruptcy Law currently being voted on, as well as on innovative institutions of Bankruptcy Law, such as the recently legislated discharge of the remaining debts of the honest bankrupt debtor who is a natural person – the “second chance”. The second chance aims to reintegrate thousands of insolvent businesses into entrepreneurship, offering them a fresh start. In addition, the simplified bankruptcy procedure for small businesses is presented.

I. Attachment of Bank Deposits (Duration 3 months / 50 hours / 1.92 ECTS)

The aim of the Unit is to provide the basic knowledge background on a specific means of enforcement for the satisfaction of claims, namely the garnishment of bank deposits, and to highlight the practical application of this means in modern economic and commercial life, as well as the limitations that the legislator places on it. The garnishment of monetary claims held by a bank, as a third party, is today, in the midst of economic recession, the most effective means of satisfying creditors. The reasons behind this, the development of legislation on the garnishment of deposits, the obligations of a credit institution after the garnishment order has been served on it, the special features of certain deposits, and the specific rules that apply when the State is involved in the procedure, either as creditor or as debtor, are some of the topics that we will examine with considerable care, so that by the end of the Course participants will have gained a comprehensive understanding of how, and in which cases, the operation of banks can be used effectively to satisfy creditors’ claims.

II. The New Bankruptcy Law (Duration 4 months / 71 hours / 2.73 ECTS)

Description

The aim of the Unit is as follows: the Course will focus on specialised topics and practical issues of business restructuring under the New Bankruptcy Code at pre-insolvency level, such as the prepackaged plan, as well as on the changes to these that have already been published in the relevant Draft of the New Bankruptcy Law. In addition, it will address the topic of “Consumer Bankruptcy”, which is now being incorporated into the New Bankruptcy Law. Upon completion of the Course, participants will have gained a holistic approach to modern bankruptcy law and will be familiar with more specialised topics, obtaining a certificate that attests to their thorough knowledge of the subject and its parameters.

III. Legalisation of Proceeds from Criminal Activities (Money Laundering) (Duration 2 months / 19 hours / 0.73 ECTS)

The Course presents, analyses and interprets the current institutional framework for the prevention of money laundering and focuses on the obligations and responsibilities of legal entities and their employees, lawyers, accountants and professionals, as well as of the competent supervisory authorities, with regard to the measures they must apply for collecting information and exercising supervision.
